Health Insurance Overpayment Laws in GA?
I work for a Provider and she received a letter from Humana stating that they had made an error and made an overpayment 9 months ago and now they want their money back or they will deduct it from future payments. Is that legal. Is there a statue of limitation on how long they have before they can’t do that? Where would I look?
Yes, it’s legal and common practice.
You don’t need to look at the state laws – all you need to look at, is the provider contract between your provider, and Humana. Those are the terms your provider originally agreed to – and it’s a standard provision, in all provider contracts.
Any time limitation on how far back they could go, would be included in that contract. And it’s likely to be three to five years.
