Health Care Proxy

In NJ when can a person be appointed as a health care proxy?
A health care proxy is a person who is the health care Power of Attorney holder.
Any adult can appoint a health care POA to any other adult of sound mind at any time he wishes.
While the patient is capable of making decisions, HIS voice is heard; if he is incapacitated (unconscious, severely demented, etc.) then the POA can and should speak for him.
You could have a person appointed, though in many cases what happens is if people didn’t have their paperwork in order and things have progressed to the point where the person can’t speak or decide for himself a guardian or conservator is appointed by a court. That costs a bundle of money and involves a judge. Again, you’d have to be an adult to serve in this capacity.
