Does Obama’s Health Care Reform Violate the US Constitution?
A candidate for state attorney general wrote the following on his web site:
The Federal Government is only granted limited and enumerated powers as specified in Article 1, Section 8 of the U.S. Constitution. When the federal government passes laws that are not authorized in Article 1, Section 8, those laws violate the Tenth Amendment to the Constitution. If elected, I will join the 20 other Attorney’s Generals in challenging the constitutionality of ObamaCare.
That is for the courts to decide since so much in the Constitution is open to interpretation by the courts.
Article 1, Section 8 has a lot of provisions and I dont know which ones they are applying to the constitutionality of the Health Care Act.
10th Amendment: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”
I think if the states do not exercise their powers to protect its citizens and to insure the well-being of its citizens, the powers revert to the federal government.
